Terms

The agreement between you and Warq when you use the app or this website. It is written to be read. Where it matters, it says what Warq will do, not only what you may not.

Who you are dealing with

Warq is run by Faza Amal Sophian, an individual in Malaysia. Write to [email protected] about anything here. What Warq keeps about you, and why, is on the privacy page.

Your account

You need to be 13 or older to use Warq. If you are younger than the age at which you can agree to this on your own where you live, a parent or guardian has to agree for you, or the school that provides your account agrees on your behalf.

Give an email address that is yours and that you can read: it is how you confirm the account and how you get back into it. Keep your password to yourself. What is done with your account is your responsibility, so tell Warq at once if you think someone else is using it.

What you put in Warq stays yours

Your notes, codes, photos, recordings and files belong to you. You let Warq store them, back them up, and show them to you and to the people you share them with, and only so far as that is needed to run Warq. When you delete something, or your account, that permission ends with it.

You are responsible for what you put in Warq and what you share. Only upload what you have the right to.

Using Warq fairly

Do not use Warq to store or share anything unlawful, to infringe someone else's rights, to harass anyone, or to spread malware. Do not try to get into anyone else's account, to get around the limits of your plan, or to overload or take apart the service. If an account does any of this, Warq may suspend or close it, and will tell you why unless the law or someone's safety says otherwise.

Plans and paying

Warq is free with 250 MB of cloud storage. Paid plans add storage: Pro has 10 GB and Max 30 GB. Prices are shown before you buy, and include any tax the seller has to charge. Being over your storage never stops you making notes or attachments; what stops is backing up new files until there is room again.

In the app, you buy through Apple's App Store, which takes the payment and whose own terms apply to it. On the web, you buy through Polar, which sells to you as the merchant of record, takes the payment, and handles the tax.

A subscription renews at the end of each period until you cancel it: in your App Store settings for one bought in the app, or through the link in Polar's receipt for one bought on the web. Cancelling stops the next renewal, and you keep your plan until the end of the period you have paid for.

Lifetime

Lifetime is paid once and never renews. It gives your account Max's 30 GB of cloud storage for as long as Warq runs. It belongs to the account it was bought for, and cannot be moved to another. Storage beyond it, where Warq offers it, is bought separately.

If Warq ever closes, every account holder is told by email at least 90 days before, and given a way to download everything in their account. No refund is owed for the closure itself.

Refunds

For a purchase made in the app, refunds are Apple's to give: ask through reportaproblem.apple.com.

For a purchase made on the web, write to [email protected] and say what went wrong. Refunds are not automatic: each request is looked at on its own, and a reason is expected. A Lifetime purchase is harder to refund than a subscription, because what it sells is the promise of every year after this one, and it is said here so that you know before you buy.

None of this takes away a right your local law gives you as a consumer, such as the right in the UK and the EU to cancel a purchase within 14 days, unless you agreed at checkout to have it start straight away and to lose that right when it does.

Keeping Warq running

Warq works to keep the service available and your backups safe, but cannot promise it will never be down or never lose anything. What is on your phone is a copy of its own, and the app keeps working without a connection.

Warq will change: features are added, changed and removed. If a change takes away something you have paid for and not yet had, you are told before it happens and offered a fair remedy.

Ending

You can stop using Warq and ask for your account to be deleted at any time, as the privacy page explains. Warq may close an account that seriously or repeatedly breaks these terms. Closing an account for that reason does not earn a refund, except where the law requires one.

Responsibility

Warq is provided as it is. As far as the law allows, Warq is not responsible for losses it could not reasonably have foreseen, or for indirect losses such as lost profit or lost opportunity, and its total responsibility to you is limited to what you paid Warq in the twelve months before the problem, or 50 US dollars if that is more.

Nothing here limits responsibility that the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud.

The law that applies

These terms are governed by the laws of Malaysia, and the courts of Malaysia can hear any dispute about them. If you use Warq as a consumer and live elsewhere, you keep the protection of the laws where you live, and you can bring a claim in your own courts.

Changes

When these terms change, the date at the top changes with them. A change that affects what you have paid for, or your rights, is told to account holders by email at least 30 days before it takes effect. If you do not agree to it, you can cancel before then.
